In relation to the Matiang’i raid, the court has extended orders prohibiting the DCI from calling lawyer Danstan Omari.Omari disputed the summons on the grounds that the information sought was protected by client advocate privilege, and Judge Hedwig Ong’udi prolonged the orders she had given two weeks earlier.
The LSK who are parties to the dispute and are interested parties have been given permission to submit their answering affidavit in support of Omari’s appeal. LSK declares their support for Omari’s application.
The fact that Omari filed two distinct cases of the same kind before the court has also drawn criticism from the authorities.
Orders were issued in the first case, which was filed with the judicial review division, and there are orders in the second case, which was filed with the constitutional division.
Yet, the cases are very different, according to Omari’s attorney Shadrack Wambui, as one challenges the procedure while the other deals with the core danger to freedom.
